Floxv respects intellectual property rights and takes copyright compliance seriously.
1. Our Position on Content
Floxv is a digital media interface and credential management service. We do not host, store, upload, cache, transmit, or control any audio, video, or media files. Our Service provides technical access credentials that connect users to independent third-party media servers operated and maintained by entities that are entirely separate from Floxv.
Floxv functions exclusively as a technology intermediary. We are not a content provider, broadcaster, or media publisher. The content accessible through third-party servers via our credentials is not owned, managed, or moderated by Floxv.
2. DMCA Safe Harbor
Floxv operates under the safe harbor provisions of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. As an online service provider that does not host or control user-uploaded or third-party content, we qualify for safe harbor protection from copyright infringement liability arising from content that we do not host.
3. Copyright Infringement Complaints
If you are a copyright owner or an authorized representative and you believe that content accessible through third-party services connected via our credentials infringes your copyright, you may submit a DMCA takedown notice. Please be aware that:
- Floxv does not control, host, or have the ability to remove content from third-party servers
- Takedown notices should be directed to the actual hosting provider of the content in question
- We will, however, log all valid DMCA notices received and cooperate with rights holders as legally required
4. How to Submit a DMCA Notice
To submit a valid DMCA takedown notice to Floxv, your notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work you claim has been infringed
- Identification of the specific material you claim is infringing (URL or description)
- Your contact information (name, address, telephone number, email address)
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner

5. Counter-Notification
If you believe that content has been incorrectly targeted by a DMCA notice, you may file a counter-notification. Counter-notifications must include:
- Your physical or electronic signature
- Identification of the removed or disabled content and its location before removal
- A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification
- Your name, address, telephone number, and a statement that you consent to jurisdiction of the federal district court for your address
6. Repeat Infringer Policy
In accordance with the DMCA, Floxv maintains a policy to terminate the accounts of users who are determined to be repeat infringers. If we receive multiple valid DMCA notices regarding activity associated with a specific account, we will terminate that account.
7. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
